"Whether the graffiti was authorised or not, the owner of the wall acquires the ownership of the graffiti (taken as an object).
The owner of the graffiti can only object to the use of a photograph of the graffiti taken by a third party if such use causes an "abnormal disturbance".
In our case, since the graffiti is illegal, and as long as the use of said graffiti does not cause abnormal disturbance to the owner of the wall where it is affixed, neither the graffiti artist, nor the owner of the wall could efficiently make a claim."
